An Israeli who lives in the north of Israel was arrested yesterday on suspicion of kidnapping her five-year-old son from his father, a Chinese doctor living in the United States. According to reports, the woman traveled to Israel with her son about three years ago, and never returned. Upon her arrest yesterday, her son was transferred to the care of a Chabad Shliach, due to the trust welfare services has in his capabilities of caring for the child.
The woman was arrested yesterday morning, after police officers pulled her over at a routine checkpoint, to check her drivers license. Police checks revealed that in December of 2006 the court issued a warrant for the child’s kidnappers, and demanded that she return the child to the father immediately.
The father went to court in Israel, through a local Israeli lawyer in 2006, and the judge ruled that children taken from a residence without consent of their parents, must be returned to their original place of residence.
The woman, 30, has lived in the US and has family in Israel. According to her, the father of the child previously granted permission for a passport for the child, and was aware that she was moving to Israel. She claims she never tried to hide in Israel, she says the child is documented fully. The police say they have been trying unsuccessfully to locate her for the past few years.
The child was transferred yesterday, by the Welfare department, to the care of a Chabad Shliach in Israel. The Shliach seeks to return the child to his mother. “He keeps asking where his mother is,” he said yesterday. “The police allowed the mother to speak on the phone with her son, and she explained that currently she can not be with him.”
“I know the child’s family for many years and he is comfortable staying with us for now,” said the shliach to COLlive.
The woman’s Attorney Nechama Tzivin said yesterday: “It was improper for the police, without just cause, to separate the child from his mother. It is possible to carry out the investigation in the matter without this separation.”
Folks, if you think that there is any truth, validity, or even decency to be found in modern secular divorce court, you are greatly mistaken.
There is no support for the notion that the better parent gets custody, nor that there is any reasonable division of assets, etc.
In most courts, restraining orders are handed out like popcorn.
Do not believe anything from these courts as valid.
You’re right – the mother did make a mistake; she actually made two mistakes! First she associated with a non Jew, then she absconded with their child. Obviously the story is a tragedy. But once the child is born to two parents, neither has the right to hurt the child by taking him/her away from his/her parents. Stealing a child from a parent is parental alienation. The wretched mother, through her horrible action, has lost her rights to parent the child. The child should be restored to the father immediately.
Doesnt she have the right to be with her child as much as the Chinese Dr.? Why should the child go back to him? and besides she is in Israel – shouldnt she the JEWISH parent have the first right to have the Jewish child!! to just take the child away like that without further investigation and trial is terrible!!!
