A lawsuit against Pakistan’s Inter Services Intelligence (ISI) and its former heads in connection with the 26/11 terror attacks in Mumbai is being blocked by the U.S. government, an Indian newspaper reported.
The lawsuit filed in the US Federal Court in the Eastern District of New York by alleges that the Pakistani Intelligence provided support to Lashkar-e-Toiba terrorist group to carry out the 2008 attacks.
Suing them are the relatives of the Rabbi Gabi and Rivky Holtzberg, the Chabad Shluchim in Mumbai who were murdered in their center along with other Jews, the Deccan Herald said.
The Holtzberg family is being represented by law firm Kriendler & Kreindler LLP.
But the US Department of State has filed a 12-page affidavit in the court stating that the ISI was entitled to immunity, because it was part of a foreign State within the meaning of the US Foreign Sovereign Immunities Act.
“Any organisation, State or non-State,” could not enjoy immunity if it was sponsoring terrorism, attorney James P Kriendler argued in return.
