Judge Reaffirms 770 Ownership

Four Supreme Court judges have reaffirmed the court's original ruling today, that two central Chabad organizations retain full ownership of 770 Eastern Parkway in Brooklyn. After a lengthy appeal, today's ruling states that Agudas Chasidei Chabad and Merkos L'Inyonei Chinuch had "all right, title and interest to the property at 770-788 Eastern Parkway." Full Document

The Court did affirm that Merkos owns the buildings. However, the Court ruled that any reference in the earlier decision to the Gabboim or Congregation must be striken from the case because they were not part(ies) of the prior case. Based on this decision, the Gabboim and the Congregation still have possesion of 770.

the final resaults show that 770 belongs to aguch not to the gabaim do to the fact that includes a large group of noncivilized animals wich causes the imposobility for a shliachs supporter to walk in. there for aguch has full permision to take down any sign of yechi or mh”m and if it take eviction, it will accure. didan natach! to aguch and merkoz!

Sounds like Aguch and Merkos are the owners and the gabbaim congregation are the tenants. Will they be charging them as much rent as the greedy landlords in Crown Heights? The court said that the case was not against the gabboim and the congregation. Does that mean that now there will be a new case against the gabboim and congregation?

look at the end of page 5 and page 6 in the first ruling: the court it saying that merkos and aguch CANNOT remove anything and anyone from the premises downstairs.
of course aguch ownes the building – no one ever said otherwise! the ruling is that from now on it will remain as before!!! that the didan notzach!
